Abstract

This document considers the responsibility of the State in Colombia as a result of failures in the legislative function, either by the absolute or relative omission in the law or the unconstitutionality of the law. Among other issues, the article discusses the opposition or restriction of the rights to reparation by lawmakers in those cases in which a law causes damage, deprives a person of rights, or restricts the operation of a given economic activity. In this perspective, the article examines the case in which the law establishes loss of property rights, and by disposition of the same law, indemnification is excluded. The treatment given by the Constitutional Court to property rights when it attempts to differentiate property right regulation from expropriation is also discussed, as well as the effects of sovereignty found in some specific cases.
