State Patrimonial Liability for the Lack of Follow-up on Premature Infants Receiving Home Oxygen Therapy after Discharge from Neonatal Intensive Care Unit
Abstract
The objective of this research work is to determine the Responsibility that derives for Health Institutions, due to the omission in the follow-up of premature infants with home oxygen support after discharge from the neonatal intensive care unit, an issue of great complexity for the pediatric Lex Artis and for Medical Law itself. For this, a Jurisprudential review will be made between the years 2018 to 2022, of the pronouncements of the Council of State in matters of State Medical Responsibility under the criterion of imputation of the failure in the service, since the hypothesis is defended that this is the criterion in which could mark the duty to repair the damage caused by omissions in this type of medical care. The research methodology is dogmatic, qualitative and deductive, its starting point is the analysis of a clinical factual problem from the jurisprudential and doctrinal review of health law and administrative law.
